The following General Conditions of Sale govern contracts for the sale of all products on the web site www.cravate-Avenue.com by the company Cravate Avenue SARL (capital €20,000) a company registered in France, to its customers.
These general conditions of sale are applicable at the time of order. They may be changed without notice and will apply to all new orders.
The company Cravate Avenue SARL is the owner of all the rights pertaining to the web site cravateAvenue.com of which it is the creator.

Validation of orders
The validation of an order implies full acceptance without reserve by the customer of the present General Conditions of Sale, which are the sole conditions applicable at the time of the order. Information recorded by cravateAvenue.com constitutes proof of all transactions between cravateAvenue.com and its customers. Information recorded by the payment system constitutes proof of financial transaction.
The company Cravate Avenue SARL reserves the right not to record a payment, therefore not to confirm an order for whatever reason: problems regarding the order received, supply problems for one or several products, possible delivery problems, technical problems, etc.
Should any of these problems arise Cravate Avenue SARL will contact the customer by telephone, letter or e-mail.
Product Characteristics
Textiles, fashion accessories, ties and other products.
The products shown on the site do not have definitive characteristics and are only available during their appearance on the site.
Photographs
Photos shown, with or without texts and descriptions of products are not contractual.
Offers are valid without geographic limitation, except where mentioned otherwise.

CravateAvenue SARL has the rights to these photos and as such, they must not be reproduced outside the CravateAvenue site. Shutterstock can sue Cravate Avenue SARL in case of dispute. We would therefore, be under obligation to sue any person or company having stolen these photos.
Protection of minors
CravateAvenue would remind you that minors under the age of 18 do not have the authority to make purchases.
Information received from them must include parental authority and we would inform them that the retaining and/or transmission of this information to third parties will be subject to their prior agreement.
CravateAvenue undertakes to ensure that marketing messages conform to the activities of their age and will not distribute any content of a nature that is unsuitable or likely to promote violence.
Offer Duration Validity
Offers are valid subject to the availability of stocks and for certain products, during specific periods, i.e. seasonal. This information will be given in the description of the product.
If, during a promotional period, an item order is not in stock, Cravate Avenue SARL will replace it with an equivalent or better item.
In other instances, Cravate Avenue SARL will inform the customer by telephone, letter or e-mail of an equivalent or better proposal. The out of stock product will be replaced after acceptance by the client. The client can equally request the cancellation of the order and its reimbursement.
Prices (Only if you are registred and connected with you login)
Product prices are net, in Euros and include VAT (if you country must pay VAT), but exclude shipping charges. They can be modified at any time without prior notice.
Items are invoiced in Euros based on the price indicated on the site at the time of the order.
The final order price includes the product price with VAT and the charges for handling, packing and shipping.
An invoice will be sent with each order.
Additional price reductions can apply if you have a specific code obtained with your loyalty points, in compensation or for a promotional offer. This price reduction will be taken into account in any possible case of reimbursement. All complaints will be based on the product price net of all reductions (including shipping if this was offered)
Loyalty Points (if active)
Points are attributed for your purchases.
By accumulating points, you can obtain reductions and/or gifts. They do not have a validity limit . In no case can these points be exchanged for money. They cannot be sold or ceded. Gifts chosen with these points cannot be reimbursed.
VAT
The European Union governs VAT regulations.
Delivery to a destination in a European Union Country: - for all deliveries to the invoice address
1) If the addressee is not subject to VAT: invoicing including French VAT.
2) If the addressee is subject to VAT: invoicing excluding French VAT with verification of addressee's VAT identification number (Inter-community VAT No.).

Delivery to a destination in a country outside the European Union:Invoicing without VAT or customs duty.
Customs duty or other taxes may be applied on importation. CravateAvenue is not responsible for these charges. They are the responsibility of the client as regards declaration and payment to the relevant authorities.
Payment
Orders are payable solely in Euros. We have chosen the French bank CAISSE D'EPARGNE for secured payments. When you have validated your order, you enter your credit/debit card details and its expiry date on the secure server of the Caisse d'épargne.
The secure server generates a request for authorisation from the card issuers. This authorisation is then displayed to you in the form of a "payment ticket" showing the transaction details (number, amount, date, company number) of the authorisation received, then sent to the company, for information and handling. Your order will then be prepared and shipped.
At no point does CravateAvenue have access to your credit/debit card number and therefore cannot record it. You can use any of the following cards: EUTROCARD/MASTERCARD, VISA, CB.
If you do not wish to pay by card you can choose to pay: - by cheque, by printing the order and sending it to us by post. (Only if you live in France, Cheque are not accepted from foreign countries)

In accordance with Law No. 80335 of 12 May 1980, (Ownership of property) the merchandise remains the property of CravateAvenue SARL until full payment is received.

Shipping charges
Merchandise is shipped via the French postal service. Merchandise is shipped at the risk and peril of the client. It is the responsibility of the client to verify the package on receipt and refuse it if it is not acceptable.
Shipping is free on orders over €75 for continental France only.

All our products can be shipped to the countries quoted, except where government regulations stipulate the contrary and excluding zones or countries excluded from postal services at the time of your order.

Shipping and Delivery Dates
Your order is dealt with within 24 hours of its receipt (from Monday to Friday)
We confirm by e-mail as soon as your payment has been validated.
Dispatch is ensured in two days both for deliveries in continental France and for other countries, unless indicated to the contrary.
We will send you an e-mail confirming shipping.
The preparation period is indicated in working days, as faithfully as possible and is subject to the availability of products, order volume, the period during which you placed your order (preparation periods at Christmas and New Year can be 8 days) and cases of force majeure.
So that delivery can be made as soon as possible, you must give us the name and telephone number of the addressee. It is not recommended to use a poste restant address or a post office box number.
Shipping is by "Colissimo Suivi" the French postal service.
Delivery is made to the address indicated by the client at the time of order.
Delivery is made within a maximum of 7 days (continental France) from the date of the confirmation e-mail, except in the case of force majeure (strikes, terrorist acts, war, natural and weather catastrophes, etc.)
Where delivery cannot be made within the time indicated, CravateAvenue SARL will propose a new delivery date to the client, which if not accepted, will lead to cancellation of the order and the reimbursement of the order amount by CravateAvenue.
This reimbursement will be made within 14 days maximum from the date of order cancellation.

For all dispatches made via Colissimo Suivi or international postal service, as for carriers, you must sign a receipt for the package.
Delivery times indicated are those normally observed, they are given as an indication and cannot be considered contractual.
Delivery times are in working days and are excluding force majeure and postal or transport difficulties. When your order is passed to the postal services or the carrier, CravateAvenue can no longer be held responsible for any delays in deliveries that are over long or are irregular, possible damage to products in the case of late collection or non-collection of the said products by the buyer.
The exceeding of delivery times cannot give rise to deductions, or damages or interest, or the cancellation of an order in progress.
Nevertheless, if your order has not been delivered within 30 days, we would offer: either a new delivery date, or the cancellation of your order and/or its reimbursement.
Postal deliveries are limited to 30 kg. Above this weight, we use the services of a national or international carrier. Please contact us to calculate the best solution at the best rate.
Delivery of merchandise is at the risk of the purchaser. On receipt of your package and before opening it, verify the packing. If you see that the package is damaged tell the carrier and note your observations on the delivery slip. Any damage must be notified by letter by recorded delivery against signature within 3 days to the French Post Office, or the carrier, with a copy to CravateAvenue SARL.
If you observe any damage, we would be grateful if you would notify us as soon as possible so we can assist you.
Taxes and Customs Duty
The European Union governs the regulations.
Delivery to a country outside the European Union and in the DOM TOM:
- possible customs duty, taxes or other charges are the responsibility of the client.
The amount of taxes depends on the regulations in force in the country of destination. CravateAvenue has no control over these taxes and cannot predict their amount.
It is the client's responsibility to inform himself of the customs regulations in force in his own country and any import limitations on the products he wishes to order.
Guarantees All our products are guaranteed and have undergone all the care necessary to ensure they conform. If an item is faulty, we would ask you to return it in its original packing within 7 days, by recorded delivery against signature and we will exchange it, give you a credit or reimburse you.
No return of merchandise can incur any indemnities, damages or interest.
Gifts For all gifts delivered to countries outside the European Union, under Customs regulations and so as not to delay or prevent delivery we are obliged to indicate the value of the gift and equally to attach the invoice to the package.
The Parties' Undertakings CravateAvenue SARL undertake, once the order is accepted and paid for, to deliver the items ordered to the client within the delivery times indicated.
The client undertakes to give CravateAvenue a precise address where delivery can be made on working days and during working hours.
Satisfaction or Money Back Guarantee In accordance with Article L121-16 of the "Code de la Consommation" (Consumer Act), the client has a period of seven working days from the date of receipt of order to return products to CravateAvenue SARL for exchange or reimbursement, without penalties, with the exception of return charges.
Reimbursements are made within 15 days of receipt of the products returned.
When returning merchandise to CravateAvenue SARL, please give us precise details of your name, address, date and order number and your telephone number.
Liability Limits The products we pass to carriers are in conformity with, and are our responsibility as regards French regulations, the sole regulations that govern CravateAvenue SARL.
After dispatch, any product exposed to damp or damaged for any other reason cannot be guaranteed by CravateAvenue SARL. The transfer of risks takes place when the products are passed by CravateAvenue to the postal services or the carriers.
Litigation All orders placed entail the acceptance by the client, and this without any qualifications, of the CravateAvenue General Conditions of Sale.
In the case of dispute, our Customer Service Department is at your disposition to deal with a disagreement.
In all cases, we will respond to any request for information or complaint, whatever the method: letter, data communication or telephone call.
Complaints will be dealt with within 10 days of their receipt at our offices.
All sales disputes will be handled under French Law at the Tribunal de commerce in Bourg en Bresse, the sole authority empowered to deal with possible litigation.
